Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the https://www.treknomads.com website (the "Service") operated by TrekNomads ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Incorporation of Trek Policies

By booking any trek, expedition, or service with TrekNomads, you explicitly agree to be bound by our operating policies, which are incorporated by reference into these Terms:

• Cancellation Policy: All cancellations, rescheduling requests, late payment penalties, voucher redemptions, and refund calculations are strictly governed by our Cancellation Policy.

• Indemnity Bond (Trekker Declaration and Safety Agreement): Participation in any trek is strictly contingent upon signing and submitting our Indemnity Bond prior to departure. Failure to submit this document will result in cancellation of participation without refund.

• Mandatory Medical Certificate (Multi-Day, Himalayan & High-Altitude Treks and Expeditions): For all multi-day treks, Himalayan expeditions, and high-altitude itineraries (as specified on the trek details page), participation is strictly subject to the submission of a valid Medical Certificate signed by a registered medical practitioner. The certificate must confirm that the participant is medically fit for high-altitude exertion and must be submitted at least 7 days prior to departure (or as stipulated in your pre-trek instructions). Failure to submit a valid medical certificate will result in automatic disqualification from the trek without any refund of the booking deposit or trek fees.

• Fitness Criteria Proof & On-Site Evaluation: Treks require specific levels of cardiovascular and physical endurance. Where applicable, participants must submit required Fitness Criteria Proof (such as time-stamped running, jogging, or endurance tracking logs via fitness apps as specified by TrekNomads) within the designated timeline before departure. Additionally, TrekNomads reserves the right to conduct on-site physical fitness assessments at basecamp or during the trek. Failure to meet the mandatory fitness criteria, or an inability to maintain required safety turnaround times on the trail, will result in immediate disqualification or being sent down by the Trek Leader. Cancellations or removals due to fitness disqualification are governed strictly by our Cancellation Policy, and no refunds or vouchers will be issued for unused days.

2. Booking Deposits & Balance Payments

When booking a trek with TrekNomads, the following payment terms apply:

• Non-Refundable Booking Deposits: For multi-day treks, expeditions, and international trips, you may reserve a slot by paying an initial booking deposit. This registration fee represents a strictly non-refundable booking deposit utilised immediately to cover administrative, permitting, and advance operational costs. Paying a deposit reserves your slot but does not constitute a final trek confirmation until full payment is received.

• Balance Payment Due Dates: To confirm participation, the remaining balance of the total trek cost must be paid in full at least 30 days before the departure date.

• Late Payment Penalties & Default: Should you fail to clear the remaining balance by the 30-day deadline, late payment fees will automatically apply as outlined in our Cancellation Policy:

  • A 5% late fee (based on the total trek cost) will be added if payment is made up to 21 days before departure.

  • A 10% late fee (based on the total trek cost) will be added if payment is made up to 15 days before departure.

  • Failure to clear the full balance and applicable late fees by the 15-day deadline will result in the automatic cancellation of your booking, with the initial booking deposit remaining strictly non-refundable.

3. Links To Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by TrekNomads.

TrekNomads has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that TrekNomads shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

4. Termination of Access

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

5. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Karnataka, India, without regard to its conflict of law provisions. Any legal disputes, claims, or proceedings arising out of or related to these Terms, our Service, or any trek booked with TrekNomads shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

6. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Any updates or modifications will take effect immediately upon being posted on the Service. The Terms and Cancellation Policy in effect at the exact time of your booking will govern your specific transaction.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
